1. Terms of Service

Article 1 (Purpose)

These Terms of Service ("Terms") govern the rights, responsibilities, and obligations between the user ("User") and Newert Inc. ("Company") regarding the use of the mobile application “CoEmo” ("Service") provided by the Company.

 

Article 2 (Definitions)

"Service" refers to the mobile application provided by the Company.

 

"User" means any individual who accesses or uses the Service in accordance with these Terms.

 

Article 3 (Effectiveness and Changes to the Terms)

These Terms shall take effect when posted on the initial screen of the Service or via a linked page accessible through the Service, or through any other notice method.

 

The Company may amend these Terms in accordance with applicable laws and regulations. Any revisions will be announced in advance through in-app notifications or public notices.

 

Article 4 (Use of Service)

Android users may access the Service using their Google accounts.

 

iOS users may access the Service using their Apple accounts.

 

The Service is accessible via social login without a separate registration process.

 

Article 5 (Personal Data Protection)

The Company complies with relevant data protection laws and has established a Privacy Policy to protect Users' personal information, which is made publicly available and strictly followed.

 

Article 6 (Limitation of Liability)

Unless due to willful misconduct or gross negligence, the Company shall not be liable for any damages arising from the use of the Service.

 

Article 7 (Governing Law and Dispute Resolution)

Any dispute arising between the Company and the User in relation to the Service shall be subject to the jurisdiction of the courts located at the Company's principal office in Korea.

 

2. Privacy Policy

Newert Inc. ("Company") respects your privacy and is committed to complying with applicable data protection laws, including the Personal Information Protection Act of Korea. This Privacy Policy explains how the Company collects, uses, and protects your personal information when you use the EmoFit app ("Service").

1. Information We Collect

To provide our Service, we collect the following types of personal information:

  • Account Information: Google account ID, Apple account ID

  • Sensor Data: Biometric or behavioral data collected from device sensors while using the Service (e.g., accelerometer, physical activity metrics)

2. Purposes of Data Collection and Use

Collected personal information is used for the following purposes:

  • User identification and login

  • Providing personalized features and analyzing user status

  • Improving service functionality and user experience through statistical analysis (with de-identified data)

3. Retention and Use Period of Personal Data

  • Personal data is retained during the period of service usage. It is deleted immediately upon user request or account deletion.

  • If data retention is required by law, such information will be retained for the legally mandated period and deleted thereafter.

4. Third-Party Sharing and Outsourcing

  • The Company does not share or outsource personal data to third parties.

  • If such sharing or outsourcing becomes necessary, it will be done only after obtaining prior consent and providing detailed notification.

5. Automatic Collection Tools

  • During service use, certain device information (e.g., device identifier) may be automatically collected.

  • Users can restrict data collection via mobile OS or app settings. Please note that disabling such settings may limit certain features of the Service.

  • If key functionality relies on specific data, restricting collection may result in limited usability.

6. Data Disposal Procedures and Methods

  • Personal data will be promptly deleted when it becomes unnecessary, such as after the retention period expires or the purpose of processing is fulfilled.

  • Electronic data will be irreversibly deleted using secure methods, and paper documents will be shredded or incinerated.

7. Measures for Data Security

The Company takes the following steps to safeguard personal information:

  • Access controls and permission limitations

  • Data encryption and secure storage

  • Installation and monitoring of security software

  • Regular security training for data handlers

8. User Rights and Exercising Rights

Users may request access, correction, deletion, or suspension of their personal data at any time by contacting the Company via email. We will process such requests promptly after verifying the identity of the requester.

9. Data Protection Officer

Users may contact the Data Protection Officer for any inquiries, complaints, or requests related to their personal information. We will respond and address your concerns without undue delay.

If you have suffered a violation of your rights due to actions or inactions of a public institution, you may also file an administrative appeal through the Central Administrative Appeals Commission.

10. Changes to This Privacy Policy

This Policy takes effect from the date of implementation. If there are any changes, including additions, deletions, or modifications, they will be announced via in-app notifications at least 7 days in advance.
